Revised Access Terms and Conditions – Effective 17th November 2006

Access to this site, www.finatiq.com, is granted by finatiQ, a division of Bank of Singapore Limited ("finatiq.com"), subject to the following terms and conditions. By accessing this website, you agree to be bound by the access terms and conditions below.

Disclaimer
The information and materials contained in this website, including services, products, information, data, text, graphics, audio, video, links or other items are provided "as is", and "as available". finatiQ does not warrant the accuracy, adequacy or completeness of such information and materials and expressly disclaims liability for errors or omissions in such information and materials.

The information contained in this website may be modified, deleted or replaced from time to time and at any time in the absolute discretion of finatiQ.

No warranty of any kind, implied, express or statutory, including but not limited to any warranties of title, non-infringement of third party rights, merchantability, satisfactory quality, fitness for a particular purpose and freedom from computer virus, is given in conjunction with this website, or any information and materials.

No warranty is given that access to any information or materials on this website, or this website as a whole will be provided uninterrupted or free from errors or that any identified defect will be corrected; further, no warranty is given that this website or any information or materials are free from any virus or other malicious, destructive or corrupting code, agent, program or macros.

Internet Provisions
The Customer shall be responsible for obtaining and using the necessary web browser and/or other software and/or equipment necessary to obtain access to finatiq.com at his own risk and expense. If new or different versions of the web browser and/or other software and/or hardware and/or equipment necessary for the operation of finatiQ become available, finatiQ reserves the right not to support any prior version of the web browser or other software. If the Customer fails to upgrade the relevant software and/or web browser or to use the enhanced version of software and/or web browser as required by finatiQ, finatiQ may reject Customer transactions, or process Customer transactions incorrectly, or the Customer may not be able to obtain access to all features and/or services available, and finatiQ shall not be held liable as a result thereof.

The Customer may perform transactions only if the Customer has been provided by finatiQ with (a) a Customer login identification number ("Login ID") and (b) a personal identification number, password, symbol or code ("PIN") and such Login ID and PIN are and remain valid, and provided always that the
Customer complies with all requirements, instructions and specifications relating to Security Devices and/or Security Codes as may be prescribed by finatiQ at any time and from time to time in its sole and absolute discretion. finatiQ may at any time in its sole and absolute discretion invalidate the Login ID, PIN, any Security Code and/or any Security Device without assigning any reason therefor without prior notice and shall not be liable or responsible for any loss or damage suffered by or caused by the Customer or arising out of or connected or by reason of such invalidation. In these terms and conditions, “Security Code” and “Security Device” shall have the meanings ascribed respectively thereto in finatiQ’s Investment Account Terms and Conditions.

In addition to the Login ID, PIN and (where applicable to the Customer) Security Code and Security Device, the Customer is required to maintain the appropriate hardware and software in order to communicate with finatiQ.

finatiQ may from time to time without giving prior notice, upgrade, modify, suspend or alter part or whole of the web-site for accessing finatiq.com and shall not be liable if any such upgrade, modification, suspension or alteration to the web-site that prevents the Customer from accessing finatiQ.com or any part or feature thereof.

The Customer's Login ID, PIN and any Security Device issued by finatiQ may be despatched by finatiQ to the Customer at the last known address or may be collected by the Customer as the case may be at the Customer's own risk. The Customer shall not at any time disclose the Login ID, PIN and/or any Security Code to any person (including any employee of finatiQ).

Exclusion of Liability
finatiQ shall in no event be liable for any damages, loss or expense including without limitation, direct, indirect, special, or consequential damage, or economic loss arising from or in connection with:Any access, use or the inability to access or use this website, or reliance on the contents of this website;Any system, server or connection failure, error, omission, interruption, delay in transmission or computer virus; Any use of or access to any other website linked to this website; Any services, products, information, data, software or other material obtained from this website or from any other website linked to this website, even if finatiQ or its agents or employees are advised of the possibility of such damages, losses and/or expenses. Any hyperlink to any other website is not an endorsement or verification of such website and such website should only be accessed at the user's own risks. This exclusion clause shall take effect to the fullest extent permitted by law.

The Customer shall be responsible and liable for any disclosure or use whether (authorised or unauthorised) of the Login ID, PIN, Security Code and/or any of the Customer's Investment Account (s) by the Customer or any other person. finatiQ shall not be responsible or liable for any loss caused to or damage incurred or suffered by the Customer or any person by reason of or arising from or as a consequence of using the Login ID, PIN and/or Security Code and transferring funds and/or performing any transactions in connection with any Investment Account (s) of the Customer with finatiQ and/or obtaining and/or making any payment of any monies belonging to the Customer.

finatiQ shall be entitled to act on any instructions or communications transmitted electronically or otherwise by the Customer or any person by any use (whether authorised or unauthorised by the Customer) of the Customer's Login ID, PIN and/or Security Code and shall not be liable for any loss to the Customer by so doing. The Customer acknowledges that unless the Customer receives confirmation or receipt from finatiQ, the Customer's instructions may not have been received and accordingly, may not be carried out.

finatiQ shall not be responsible or liable for any loss, damage or embarrassment incurred or suffered by the Customer in relation to or in respect of any instructions, operations or transactions effected by the Customer or purported to be effected by the Customer using finatiQ's services howsoever caused including but not limited to the Customer's non-compliance with finatiQ's instructions and finatiQ's inability to provide services as a result of malfunction partial or total failure of any data processing system, security system, computer teletransmission or telecommunications system or other circumstances beyond the control of finatiQ.

Governing Law and Jurisdiction

Any services offered through this website are made by finatiQ in Singapore. Nothing in this website shall be construed as finatiQ providing services and facilities outside of Singapore. By accessing this website and/or using the services offered through this website, you agree that Singapore law (including without limitation, the provisions of the Evidence Act (Cap. 97) and the Electronic Transactions Act (No 25. Of 1998)) shall govern such access and the provision of such banking services and you agree to submit to the non-exclusive jurisdiction of the Singapore courts.

In the event that the laws of the jurisdiction you are in do not permit or impose restrictions on the access to the contents of this website, you shall forthwith discontinue access or comply with such restrictions (as the case may be).

A person who is not a party to any agreement governed by these terms and conditions has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any term of these terms and conditions.

These terms and conditions shall be read in conjunction with finatiQ’s Investment Account Terms and Conditions. In the event of any conflict, finatiQ’s Investment Account Terms and Conditions shall prevail over these terms and conditions.
